Article 1 (Purpose)

These Terms of Use (hereinafter referred to as "these Terms") set forth the conditions for using the service (hereinafter referred to as "the Service") for downloading and selling sound material data (hereinafter referred to as "the Content") on propanmode (hereinafter referred to as "this Site"). Users of the Service (hereinafter referred to as "Users") shall use the Service in accordance with these Terms, each sound license agreement, and other terms of use stipulated by this Site. The individual provisions separately stipulated by this Site and additional provisions posted on this Site or notified to Users from time to time constitute part of these Terms. If there is any discrepancy between these Terms and the individual or additional provisions, the individual and additional provisions shall take precedence. By using the Service, the User is deemed to have agreed to these Terms.

Article 2 (User Registration)

Users of the Service shall register as a user through the method specified by this Site and open a dedicated personal account. The My Page is for use only by the User and may not be transferred or shared with a third party. If it is found that multiple people are using the same account, this Site may charge the User an additional usage fee calculated by multiplying the price of the Content by the number of excess users. If there is a change in the registered information, the User shall immediately follow the prescribed procedure for change.

Article 3 (User Personal Information, etc.)

All personal information obtained through the Service will be handled in accordance with this Site’s security policy, and the User agrees to this.

Article 4 (Purchase of DL Points and Payment, etc.)

The method for purchasing the Content shall be governed by this Article and the rules separately set forth on this Site. Users shall purchase dedicated DL Points (hereinafter referred to as "DL Points") which can be used only for the Service, and use those points to pay for the Content. In such cases, the use of DL Points shall be in accordance with this Article and the DL Point usage guide and other rules stipulated by this Site. A purchase agreement between the User and this Site for the Content and DL Points is established at the moment when the User clicks the "Purchase" button on the confirmation screen and the purchase procedure is completed. Notwithstanding the above, this Site may cancel its expression of intent to accept the purchase in the following cases. In such cases, this Site shall not be liable for any damages incurred by the User.
(1) If it is found that the entered information differs from the facts (including false statements, errors, and omissions)
(2) If the sale of the relevant Content is discontinued by this Site
(3) If this Site deems cancellation necessary for any other reason
This Site may change the payment method. Please check the payment conditions before making a purchase. Once a purchase agreement is established, the purchased Content or DL Points will be added to the User’s My Page, and the right to use them will be granted. After this, the User cannot cancel the purchase agreement. Please note that the purchased Content or DL Points are non-refundable and cannot be exchanged for cash.

Article 5 (Use of Contents, etc.)

Downloading operations, communication, and purchase procedures for the Content shall be carried out at the User’s own expense and responsibility. All copyrights, trademark rights, intellectual property rights, and all other rights related to the Content, and all software, files, emails, and information (collectively referred to as "Materials") provided through the Service belong to this Site or the provider of the Materials. These rights are not transferred to the User. Unless explicitly granted by these Terms or individual license agreements, the User shall not acquire any rights through the Service. The license for using the purchased Content (hereinafter referred to as "Purchased Content") shall be governed by the Sound Material License Agreement. Users may back up Purchased Content at their own responsibility in preparation for events such as PC failure or OS reinstallation. Even if the Service allows repeated downloads of the Purchased Content, this does not guarantee that downloads will be available indefinitely. Users must not modify, adapt, reproduce, distribute, display publicly, transfer, lend (whether for profit or not), transmit via the internet or any network, or otherwise infringe on the rights of the right holder beyond what is permitted in paragraph 2 of this Article. This Site shall not be liable for any damages or disputes arising from the User’s violation of the above obligations. If this Site incurs damages due to such reasons, the User shall be liable for compensation.

Article 6 (Cancellation Policy)

Only in cases where this Site deems it difficult to redistribute the Content due to discontinuation or suspension of sales, the DL Points received from the User for the relevant Content will be refunded.

Article 7 (Suspension and Discontinuation of Service)

This Site may suspend or discontinue part or all of the Service with prior notice. However, in the following cases, the Site may take necessary measures such as suspending or discontinuing part or all of the Service without prior notice. The Site shall not be liable to the User in such cases: (1) If natural disasters, incidents, or other emergencies occur or are likely to occur, making it impossible to provide the Service (2) If there are inevitable reasons such as failure or accident of the Site’s telecommunications equipment or system (3) For regular or emergency maintenance of the Site system to ensure smooth service (4) If system overload or operational issues are determined by the Site (5) If there is a need to ensure User security (6) If the Site determines that it is necessary to suspend or discontinue the Service. This Site may change, add, or discontinue the Service at any time without prior notice and shall not be held liable for such changes.

Article 8 (Prohibited Acts)

Users shall not engage in any of the following acts when using the Service: (1) Violations or potential violations of these Terms, laws, or public order and morals (2) Infringement or potential infringement of the rights of the Site, the creators of Materials, or third parties (3) Infringement or potential infringement of the property or privacy of the Site or third parties (4) Acts that damage the credibility or cause disadvantage to the Site or third parties (5) Sending harmful computer programs to the Site’s server, unauthorized access, or attempting such acts (6) Obstructing the operation of the Service or defaming others (7) Using the Service for profit or conducting business activities using the Service (8) Impersonating a third party or entering false information (9) Criminal acts, acts related to criminal acts, or acts that may lead to criminal acts (10) Any other acts that the Site deems inappropriate

Article 9 (Disclaimer)

This Site makes no warranty regarding the truth, accuracy, usefulness, reliability, fitness for a particular purpose, or the absence of viruses in the Materials. This Site does not guarantee uninterrupted access or security of the Service and shall not be liable for any loss or damage arising from defects in the Service, including suspension or interruption as per Article 7. This Site is not responsible for damages due to communication failures, system downtime, data loss, or unauthorized access. Information may change without notice, and the Site may change or update Content and programs without notice. The Site shall not be liable for any damages caused by such changes. The Site may provide Users with information or advice at its discretion, but shall not be liable for it. This Site does not guarantee operation with specific devices (compatibility issues). This Site is not responsible for lost data, corrupted Purchased Content, or any related issues, regardless of cause. Under no circumstances shall this Site be liable for damages (including loss of profits or data) arising from the use or inability to use the Purchased Content. This Site assumes no responsibility for any damages arising from the content or links on this Site. This Site shall not be liable for damages caused by the User's breach of these Terms.

Article 10 (Limitation of Liability for Damages)

Even if the Site is found liable for damages in connection with the use of the Service, compensation shall be limited to direct damages and shall not include loss of profit or other indirect or special damages.

Article 11 (Claims for Damages by This Site)

If the User violates these Terms and causes damage to the Site, the Site may claim compensation for the damages and expenses (including attorney fees). If a member violates Article 8, the Site has the right to seek an injunction based on copyright law or other laws.

Article 12 (Prohibition of Transfer, etc.)

Users may not transfer, lend, inherit, or use as collateral their status as a User or any rights or obligations, in whole or in part.

Article 13 (Revision of Terms)

This Site may amend these Terms at any time without prior notice or consent from the User. The revised Terms shall take effect when posted on the Site, unless otherwise specified. Continued use of the Site after the posting of revised Terms constitutes acceptance of the changes by the User.
